Critical Evidence
The Wiretap That Never Was
On March 14, 2026, @ProjectConstitu published the most viral tweet in the entire dataset. It was false. He admitted it. Here's the sequence.
Step 1: The False Claim
March 14, 202611.6M engagements
"THE SMOKING GUN: Leaked DOJ Wiretap Audio Captures Erika Kirk Scheduling Underage Girls for Epstein. I have been sent a bombshell audio file, and I have verified its authenticity. This is not a rumor. This is not a theory."
He claimed to have "verified" an audio file identifying Erika Kirk. He had not. The voice belonged to someone else entirely.
Step 2: The Doubling Down
March 14, 2026 (hours later)7,036 likes
"FOLLOW-UP: The Erika Kirk Audio is REAL, and the context is even more DAMNING than we Initially Thought."
Before correcting, he amplified the false claim to his audience.
Step 3: The Quiet Correction
March 14, 2026 (later)2,081 likes (5% of original)
"CORRECTION: I would like to issue a correction regarding my previous post where I claimed the audio featured Erika Kirk. Upon further verification, the individual in the recording is actually Haley Robson."
The math is damning: 38,582 people liked the false accusation. Only 2,081 saw the correction. Tens of thousands of people still believe Erika Kirk was recorded scheduling underage girls for Epstein. She wasn't.

Legal Exposure
Why This Matters Legally
A brief overview of the defamation exposure this campaign creates. This is informational analysis, not legal advice.
Defamation Per Se
All 4 categories met: criminal conduct, professional harm, sexual misconduct, moral turpitude. Damages presumed without proof of specific monetary loss.
Actual Malice
The wiretap retraction proves the account claimed "verification" it never performed. The cease & desist defiance shows continued intentional publication.
Massive Reach
273K followers. Top 30 flagged posts exceeded 40M engagements combined. The false Epstein claim alone hit 11.6M.
2 Cease & Desists
TPUSA sent at least 2 cease & desist letters. The account posted them publicly and continued escalating. This is usable as evidence of continued intentional conduct.
The "Allegedly" Defense Won't Work
The account occasionally uses "ALLEGEDLY" or frames accusations as questions ("Was She Hiding In An Office For a CIA Front Company?"). Courts have consistently held that this framing does not immunize defamatory content. Under the "totality of circumstances" test, if the overall impression to a reasonable reader is factual assertion, hedging language provides no protection. When the surrounding text uses "BOMBSHELL," "SMOKING GUN," "PROVES," "DESTROYED," and "EXPOSED"... the overall impression is overwhelmingly one of factual assertion, not speculation.
